The agreement that guides our relationship with every Waivy Baby family.

Welcome to Waivy Baby. These Terms and Conditions ("Terms") govern your use of waivybaby.com and waivybabywellnessclub.com (the "Websites"), as well as our curated baby product collections, premium membership programs, and parenting support services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

01 Acceptance of Terms

Waivy Baby ("we," "us," or "our") provides a platform dedicated to supporting parents through curated products and expert guidance. By creating an account, enrolling in a membership, registering for a seminar, booking or receiving support services, or purchasing from us, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

We may add, remove, modify, or discontinue any part of the Services at any time, subject to applicable law and any additional terms provided at checkout or within the applicable Service description.

03 Medical Disclaimer & No Professional Relationship
⚠️ Important: Not Medical Advice

Waivy Baby is not a medical provider. Our content is for general educational and informational purposes only. If you think you or your child may have a medical emergency, call 911 immediately.

  • No Professional-Client Relationship: Your use of the Services does not create a physician-patient, therapist-patient, counselor-client, attorney-client, fiduciary, or other professional relationship between you and Waivy Baby or any of our experts, contractors, or representatives.
  • Not a Substitute for Professional Care: Always seek the advice of your pediatrician, lactation consultant, therapist, or other qualified provider for any medical condition, mental health concern, feeding issues, allergies, medications, developmental delays, or the health and safety of your child or family.
  • Emergency Guidance: If you think you or your child may have a medical emergency, call 911 or go to the nearest emergency room immediately. Do not delay seeking professional care based on anything received through Waivy Baby.
  • As-Is Advice; No Guarantees: Guidance and recommendations are provided "as is" and "as available" and may not be appropriate for your circumstances. Outcomes vary by child and family — we do not guarantee results.
  • Your Responsibility: You are solely responsible for decisions you make and actions you take in connection with the Services, including implementing routines, feeding practices, sleep practices, and developmental activities, and for supervising your child at all times.
  • Assumption of Risk: To the maximum extent permitted by law, you assume all risks arising from or relating to your use of or reliance on the Services.
04 Membership Program

By enrolling in a Membership, you agree to the following terms governing subscriptions, billing, renewals, cancellation, surprise drops, and limited-edition boxes.

  • Ongoing Service: A Membership is an ongoing service, not a one-time purchase. It begins on sign-up date and continues for your selected billing interval (monthly or annual).
  • Recurring Billing Authorization: You expressly authorize Waivy Baby to charge your payment method on a recurring basis for Membership fees, applicable taxes, and shipping (if applicable).
  • Automatic Renewal: Unless you cancel, your Membership renews automatically at the end of each term at the then-current fee.
  • Failed Payments: If payment fails, we may retry charges, suspend benefits until payment is received, and/or terminate your Membership. You remain responsible for all amounts due.
  • Cancellation Method: Cancel via your account dashboard or by contacting customer support through the Websites.
  • Cancellation Timing: Cancel at least 48 hours before your renewal date to avoid being charged for the next term. Your Membership remains active through the end of the current paid term.
  • No Prorated Refunds: We do not provide prorated refunds for partial Membership Terms except where required by law or stated in our Refund & Booking Credit Policy.
  • Pricing Changes: We may change pricing from time to time with notice as required by law. Updated pricing takes effect at the next renewal after the notice period.
  • Not Guaranteed; While Supplies Last: Drops are offered while supplies last and are not guaranteed. Quantities may be extremely limited, time-limited, geography-limited, and/or eligibility-limited.
  • No Rainchecks; Substitutions: We do not guarantee rainchecks or restocks. If a Drop involves a physical item, we may substitute items of equal or greater value if necessary due to supply constraints.
  • One Per Member / Anti-Abuse: We may limit Drops to one per member or one per household to prevent abuse and ensure fairness.
  • Shipping and Taxes: Shipping fees and taxes may apply unless explicitly stated otherwise at checkout.
  • Active Membership Required: You must have an active, paid Membership at the time of eligibility determination to access Drops.

Membership may include access to exclusive content, expert seminars, workshops, Q&As, recordings, guides, and templates ("Member Content"). Access to Member Content:

  • Is provided only while your Membership is active and paid;
  • May be time-limited (e.g., limited replay windows), capacity-limited (e.g., seat limits), or otherwise restricted as described in the applicable posting or event page; and
  • May be modified, replaced, rescheduled, or removed as part of ongoing product and service updates.

To the maximum extent permitted by law, you agree not to initiate a chargeback or payment dispute for any authorized charge under these Terms. If you believe a charge is incorrect, contact us first at legal@waivybaby.com and allow a reasonable opportunity to investigate. Initiating a chargeback without first contacting us may result in suspension or termination of your account and you agree to reimburse Waivy Baby for any chargeback fees and reasonable costs incurred.

05 Ordering & Payments
  • Product Descriptions: We strive for accuracy but do not warrant that descriptions, images, colors, or included items are complete or error-free. Box contents may vary based on availability, and substitutions of equal or greater value may occur.
  • Pricing: All prices are in USD and subject to change without notice (except as described for subscription renewals in Section 4).
  • Payment Methods: We accept major credit cards and authorized third-party payment processors. You represent that you have the legal right to use any payment method provided.
  • Taxes: You are responsible for applicable taxes, which will be calculated and displayed where required.
  • Order Acceptance: We reserve the right to refuse, cancel, or limit any order at our sole discretion. If we cancel an order after charging you, we will issue a full refund to your original payment method.
06 Shipping & Delivery
  • Processing: Orders are typically processed within the timeframe specified on the product page.
  • Risk of Loss: All physical items are shipped pursuant to a shipment contract. Risk of loss and title pass to you upon our delivery to the carrier.
  • International Shipping: Customers are responsible for any customs, duties, or taxes incurred for international deliveries.
07 Cancellations, Refunds & Credits

Our policies regarding cancellations and refunds are governed by the specific Waivy Baby Refund & Booking Credit Policy.

  • Booking Cancellations: A 48-hour notice period is required for rescheduling expert consultations.
  • Product Returns: Due to the nature of baby products and hygiene standards, certain items may be non-returnable. Please refer to our Refund Policy for specific eligibility requirements.
08 User Accounts, Conduct & Security
  • Account Creation: Certain features require an account. You agree to provide accurate, current, and complete information and keep it updated.
  • Eligibility: You must be at least 18 years old (or the age of majority where you live) to create an account and use paid Services.
  • Account Security: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

You agree not to:

  • Use the Services for any unlawful purpose;
  • Interfere with or disrupt the Services;
  • Attempt to access non-public areas of the Services;
  • Scrape, reverse engineer, or circumvent security features;
  • Harass, abuse, threaten, defame, or harm others; or
  • Upload or transmit viruses or malicious code.

When using our portal, member areas, seminars, chats, comments, or community features, you agree to:

  • Be respectful and supportive toward other parents and our team;
  • Not harass, bully, stalk, threaten, defame, or discriminate against others;
  • Not post unlawful, sexually explicit, abusive, hateful, or inappropriate content;
  • Not share or request sensitive personal data from other members beyond what is reasonably necessary;
  • Not impersonate any person or misrepresent your identity or your child's condition;
  • Not share, resell, or publicly post Member Content, seminar links, access codes, or recordings without express written permission from Waivy Baby; and
  • Not use the Services to solicit, advertise, or promote third-party goods or services without prior written approval.

We reserve the right to suspend or terminate accounts for violations of these Terms.

09 Intellectual Property

All content on waivybaby.com and within the Services — including text, graphics, logos, images, product curation, box themes, videos, seminar materials, recordings, templates, and educational materials (collectively, "Content") — is owned by Waivy Baby or its licensors and is protected by copyright, trademark, and other intellectual property laws.

  • Limited License: Subject to compliance with these Terms, Waivy Baby grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and Content for your personal, non-commercial use.
  • Restrictions: Except as expressly permitted in writing, you may not reproduce, distribute, publicly display, sell, license, modify, create derivative works from, or otherwise exploit any portion of the Services or Content. You may not record, copy, repost, or redistribute seminar content or recordings.
  • Recordings: Waivy Baby owns all right, title, and interest in seminar/class recordings (including audio, video, chat transcripts, and related materials) and may use such recordings for business purposes including training, quality, and marketing. Access to recordings is a privilege, not a guarantee.
  • Platform Communications: All communications sent through Waivy Baby's platform (messages, chat, emails, attachments, forms, and metadata) are processed, stored, and maintained as part of the Services. You grant Waivy Baby a worldwide, royalty-free license to host, store, reproduce, and use platform communications for operating, maintaining, supporting, improving, and protecting the Services.
  • Trademarks: "Waivy Baby" and all related names, logos, and slogans are trademarks of Waivy Baby or its affiliates. You may not use such marks without prior written permission.
  • Feedback: If you submit ideas, suggestions, or feedback, you grant Waivy Baby a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without compensation to you.
10 Limitation of Liability
To the maximum extent permitted by law:

Waivy Baby shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the amount you paid to Waivy Baby in the six (6) months preceding the event giving rise to the claim.

  • No Indirect Damages: Waivy Baby and its directors, officers, employees, contractors, licensors, and experts shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill.
  • Product Use & Child Safety: You are solely responsible for the safe and appropriate use of any products purchased, including reading and following all manufacturer instructions, warnings, and safety guidance.
  • Seminars & Expert Guidance: Waivy Baby is not liable for decisions you make based on informational content, concierge services, expert seminars, parental support services, or any communications through the platform. Guidance is educational and informational in nature and is used at your own risk.
  • Virtual Classes — Technical Issues: Waivy Baby is not responsible for technical failures, interruptions, latency, platform outages, device issues, recording failures, or any injury or damage arising from participation in virtual classes. You are responsible for creating a safe environment and supervising your child.
  • As-Is / As-Available: The Services, Content, and communications are provided "as is" and "as available," without warranties of any kind. Waivy Baby disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Basis of Bargain: These limitations are a fundamental basis of the bargain between you and Waivy Baby and apply even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.
11 Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Waivy Baby and its affiliates and their respective officers, directors, employees, contractors, agents, licensors, and experts (the "Waivy Parties") from and against any claims, damages, losses, liabilities, judgments, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your access to or use of the Services, products, seminars, membership benefits, support services, or Content;
  • Your reliance on, or actions taken based on, any information or communications provided through the Services;
  • Your violation of these Terms or any applicable law, rule, or regulation;
  • Your negligence, willful misconduct, or failure to supervise a child;
  • Your purchase, possession, use, misuse, or distribution of any product obtained through Waivy Baby;
  • Your communications, content, or conduct (including interactions with other users or experts); or
  • Your infringement or violation of any intellectual property, privacy, or other rights of any person or entity.

This indemnification obligation survives termination of your account and/or these Terms. Waivy Baby reserves the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification.

12 Governing Law & Jurisdiction
New York Law Governs

These Terms and any disputes arising from them are governed by the laws of the State of New York, U.S.A., without regard to conflict of law rules. All disputes shall be brought exclusively in the state or federal courts located in New York County, New York.

You consent to the personal jurisdiction of such courts and waive any objection based on inconvenient forum or lack of personal jurisdiction, to the maximum extent permitted by law. This applies regardless of where you live or access the Services.

13 Global & Multi-State Services

Waivy Baby is based in and operates from New York. We provide virtual seminars, virtual classes, and parental support services from New York, accessible to users in multiple U.S. states and internationally.

  • Not Practicing Locally: By accessing any virtual session from California, Florida, or any other state or country, you acknowledge that the Services are provided from New York. Waivy Baby is not holding itself out as engaging in the "practice" of any regulated profession (including medicine, nursing, psychology, therapy, dietetics, lactation consulting, or any other licensed service) in your local jurisdiction.
  • Local Compliance: You are solely responsible for understanding and complying with all laws, rules, and regulations that may apply to you in your location. If your local laws restrict or prohibit your use of the Services, you must not access or use them.
  • Supremacy of NY Law: New York law governs the relationship between you and Waivy Baby and any dispute, regardless of your location and regardless of where you access or use the Services.
14 Changes to Terms & Contact

We reserve the right to update or modify these Terms at any time. We will notify you of significant changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
